1. What our service is - and is not

We are a private company. We are not a government agency, a DMV, or affiliated with any state. We do not issue placards; only your state’s motor-vehicle agency can do that.

2. No guarantee of approval

We review every application individually against your state’s published requirements, but we cannot and do not guarantee that your application will be approved, or that your state will approve your paperwork. What we do promise: if you don’t qualify, you receive a full refund under our refund policy.

3. Your account and accurate information

Your dashboard is accessed through secure links sent to your email address, so keeping that email account secure is your responsibility. You agree to provide truthful, accurate information in your application. Providing false information to obtain a disability placard may be a crime in your state, and we may cancel orders we reasonably believe are fraudulent.

4. Payment terms

Our service fees are shown before you pay: $29.99 for a Temporary Handicap Placard application and $44.99 for a Permanent Handicap Placard application. Subscriptions and recurring charges vary and are for account upkeep and staying active in our internal system; this fee ranges from $14.99 to $29.99 and does not include any government fees or taxes.

Charges from us appear on your card or bank statement under the descriptor Handicap Membership.

5. Refunds

If you don’t qualify, you receive a full refund. The complete details - including how to request one and how long processing takes - are in our refund policy, which is part of these terms.

6. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising from the service is limited to the amount you paid us. We are not liable for anything you do, or fail to do, with or without a placard or permit - including how or where you park, how you use or display a placard, or any citation, fine, penalty, or other consequence of your actions. We are not liable for indirect or consequential damages, or for decisions made by any government agency, law-enforcement officer, parking authority, or court. Nothing in these terms limits liability that cannot be limited under applicable law.

7. Changes to these terms

If we update these terms, we’ll change the date at the top of this page. Orders are governed by the terms in effect when you placed them.

8. Additional Terms: Parking, Legal Compliance & Limitation of Responsibility

Parking Citations and Legal Compliance

HandicapParking.org does not issue disability parking placards, permits, licenses, or government authorizations. We provide document preparation and application review services only.

You are solely responsible for ensuring that any disability parking placard or permit used by you has been lawfully issued by the appropriate state agency and is used in accordance with all applicable federal, state, and local laws.

HandicapParking.org is not responsible or liable for:

• Any parking citation, towing, booting, impoundment, or fine.
• Any criminal or civil penalties arising from misuse of a disability parking placard or permit.
• Any suspension, revocation, confiscation, or cancellation of a disability parking placard.
• Any legal action brought against you relating to your use or misuse of a disability parking placard.
• Any decision made by a government agency, law enforcement officer, parking authority, or court.

You acknowledge that it is your responsibility to understand and comply with the disability parking laws applicable in your jurisdiction.

Client Responsibility

By using our services, you represent and warrant that all information you provide is accurate, truthful, and complete. Providing false or misleading information to obtain government-issued disability parking privileges may violate applicable law. We reserve the right to deny or cancel any order that we reasonably believe involves fraud, abuse, or unlawful activity.

Membership and Service Fees

Any recurring monthly fee charged by HandicapParking.org is solely for maintaining your account, secure client portal access, application history, customer support, and other membership-related services offered through our platform. The membership fee is not a government fee and does not purchase, renew, extend, or guarantee any disability parking privileges, permits, or placards.

Government fees, if applicable, are separate and are paid directly to the appropriate state agency.

Assumption of Risk

You acknowledge that any use of a government-issued disability parking placard or permit is at your own responsibility and subject to applicable law. HandicapParking.org does not authorize or encourage unlawful use of disability parking privileges and disclaims liability for any consequences resulting from improper or unauthorized use.

Indemnification

You agree to defend, indemnify, and hold harmless HandicapParking.org, its owners, officers, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, fines, penalties, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

• Your misuse of any disability parking placard or permit.
• Your violation of any applicable law or regulation.
• Any false or inaccurate information submitted through our website.
• Your breach of these Terms of Service.

9. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

To the fullest extent permitted by applicable law, you and HandicapParking.org agree that any dispute, claim, controversy, or cause of action arising out of or relating to these Terms, the Website, your purchase, or the services provided shall be resolved exclusively through final and binding arbitration rather than in court.

This includes, but is not limited to:

• Contract disputes;
• Consumer protection claims;
• Fraud or misrepresentation claims;
• Negligence claims;
• Warranty claims;
• Statutory claims; and
• Any other dispute arising from your relationship with HandicapParking.org.

Arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, unless another mutually agreed arbitration provider is selected.

The arbitration shall take place in Miami-Dade County, Florida, unless otherwise required by applicable law.

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration provision.

Class Action Waiver

You agree that all claims shall be brought solely in your individual capacity.

You expressly waive any right to:

• Participate in a class action;
• Participate in a collective action;
• Participate in a representative action;
• Serve as a private attorney general; or
• Consolidate your claim with the claims of any other person.

The arbitrator may award relief only on an individual basis and may not consolidate claims or preside over any class, representative, or collective proceeding.

Jury Trial Waiver

To the fullest extent permitted by law, you knowingly and voluntarily waive any right to a trial by jury.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Any legal proceeding permitted under these Terms that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.

11. Force Majeure

HandicapParking.org shall not be liable for any delay, interruption, or failure to perform caused by events beyond our reasonable control, including but not limited to:

• Natural disasters;
• Hurricanes;
• Floods;
• Fires;
• Pandemics;
• Government actions;
• Utility outages;
• Internet failures;
• Cyberattacks;
• Labor disputes;
• Third-party vendor failures;
• Payment processor outages;
• Hosting provider interruptions; or
• Any other force majeure event.

Performance shall be suspended for the duration of the event without liability.

12. Electronic Acceptance

By clicking “I Agree,” “Accept,” “Continue,” “Place Order,” or any similar button or checkbox during checkout, you acknowledge that:

• You have read these Terms of Service in their entirety;
• You understand them;
• You voluntarily agree to be legally bound by them;
• You consent to transact electronically;
• Your electronic acceptance has the same legal effect as a handwritten signature.

If you do not agree to these Terms, you may not purchase or use our services.

13. Release of Claims

To the fullest extent permitted by applicable law, you agree to release and hold harmless HandicapParking.org, its owners, officers, directors, employees, contractors, affiliates, successors, and agents from any claim, liability, demand, loss, damage, cost, or expense arising from:

• Your use of the Website;
• Your purchase of our services;
• Any government decision regarding your application;
• Delays by third parties or government agencies;
• Your use or misuse of any disability parking placard or permit;
• Parking citations, towing, fines, penalties, or legal consequences resulting from your actions; and
• Any information you provide that is inaccurate, incomplete, or misleading.

Nothing in this section limits rights or remedies that cannot legally be waived under applicable law.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and HandicapParking.org and supersede all prior agreements, communications, and understandings relating to the subject matter herein.

16. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

17. Survival

Any provisions that by their nature should survive termination - including limitation of liability, indemnification, dispute resolution, arbitration, governing law, intellectual property, releases, and payment obligations - shall survive the termination of these Terms.
